At present, the international community's discussion on the concept of "soft law" has not stopped. Most academic views believe that "soft law" refers to those non-binding rules that are used to interpret and convey the content of binding rules or to express their future a commitment to take certain actions. The treaty mentioned above is a typical "hard law" in international law, which is mandatory for the signatory countries and restricts reservations. In comparison, soft law is not binding, allowing each adopting country to modify it according to its own actual situation, and has flexibility that hard law cannot match. The field of cross-border insolvency is precisely the field where soft law can fully exert its functions. The bankruptcy law is a departmental law that integrates the legal issues of entities and procedures. The provisions of value orientation, creditor's rights determination, liquidation order, priority creditor's rights and other issues in the bankruptcy laws of various countries are their economic and political reflections at the legal level. In the EU Cross-Border Bankruptcy Regulations, the main interest center is the jurisdictional standard that determines the initiation of the main insolvency proceedings in the EU member states; in the Model Law, the main interest center determines the nature of foreign bankruptcy proceedings and the degree of relief available Key factors. It can be said that the definition of the main interest center is related to the cross-border insolvency recognition and relief links. On the issue of the definition of the main interest center, there is mainly the issue of the time standard for identification, that is, whether it should be "on the basis of start-up" or "on the basis of the time of application"; and the entity identification of the main interest center. The latter is a problem that international judicial practice has long been concerned about and has relatively rich practical experience. The former is a new issue that courts in various countries have begun to pay attention to in recent years. The current issue of cross-border bankruptcy of enterprise groups has become a key issue that should be considered when constructing a cross-border bankruptcy recognition and relief system. At present, the international community's research on this issue has gradually deepened.
